President Joko Widodo allowed the public to go home for Eid with the condition that they had a booster vaccine, this caused a polemic in the community and attracted the attention of a UM Surabaya legal expert, Satria Unggul Wicaksana, to provide a response.

Based on Circular Letter (SE) Number HK.02.02/II/252/2022 issued by the Ministry of Health (Kemenkes), regarding the follow-up booster dose of COVID-19 vaccination, the target of the booster vaccine is people aged 18 years and over. Another requirement for getting a booster vaccine is by showing an ID card.

"The thing that needs to be considered, related to before the policy is rolled out is to ensure that the policy is deemed not to be contrary to the principles of Human Rights (HAM)," said Satria Tuesday (29/3/22)

Satria explained specifically with regard to economic, social and cultural rights which Indonesia has ratified in Law Number 11 of 2005 namely the 4K mechanism namely availability, usefulness, affordability and acceptance.

Availability in question is that the government needs to ensure that the number of Covid-19 vaccines, both the 2nd and booster doses, is available, with the level of achievement of citizen vaccination reaching approximately 80%, this is in line with the large number of Muslim population in Indonesia.

Benefit means that the government needs to examine whether the policy is beneficial to citizens, by conducting outreach and ensuring that every health facility has provided various kinds of information about the vaccination, so that there are no more people who are anti-vaccine, and of course with an assertive and communicative approach between government with citizens.

"While the affordability is the extent to which people's access to dose 2 and dose 3 vaccination can be fulfilled, not only in Java, but all regions of Indonesia, including the 3T area," he added.

Finally, acceptability means the level of public acceptance of vaccine doses 2 and dose 3 in terms of safety, efficacy, halalness, and so on so that people are satisfied with the vaccination policy.

"4K must be a reference or recommendation in making a booster vaccine policy a condition for going home for Eid al-Fitr this year," he concluded.
